Terms of service

1. Purpose

These terms govern the use of the Evengo app and the evengo.ch website, published by Zacharie Seiler (see the legal notice). By creating an account, you accept them. If you do not accept part of them, do not use the service.

2. What Evengo is

Evengo is a tool for organising private events: create an invitation, gather replies, settle on a date or a place by poll, share out who brings what, ask questions, and collect the photos in a shared album.

Evengo is not a ticketing service, handles no payments between participants, and sells nothing on an organiser's behalf. We are never a party to what gets organised on the platform: an event is a matter between its organiser and their guests.

5. Free of charge, and what may change

Evengo is free today. We reserve the right to introduce paid features; they will be clearly announced, and what is free as you read this will not become chargeable without advance notice to you. Where applicable, the terms specific to those offerings — price, duration, renewal, cancellation — will supplement these terms.

Certain usage limits apply, notably on the number of photos per album and the number of participants per event. They may change in order to preserve the quality of the service.

6. Your content, and photos in particular

You keep ownership of everything you upload: text, lists, photos. We claim no ownership over your content and use it neither for advertising nor to train an automated system.

You grant us only the right to host, reproduce and display your content for the sole purpose of running the service: showing it to the people attending the event concerned, storing it, backing it up and resizing it for display. This permission is free of charge, limited to that purpose, and ends when you delete the content — subject to the backup rotation period stated in the privacy policy.

Photos of other people. By uploading a photo, you confirm that you have obtained the agreement of the recognisable people in it. The right to one's own image belongs to everyone, including guests who have no Evengo account. Anyone may ask for a photo of themselves to be taken down by writing to contact@evengo.ch, without having to justify themselves; we act on it without arguing the merits.

Albums. Access to an album, and its closing, follow the timing of the event it belongs to. A closed album accepts no new photos but remains viewable by the people who attended.

If the organiser deletes their account, the event and its album are not erased: they are detached from that person's identity and stay available to the other participants, who thereby keep their own memories. Everyone retains the ability to delete the photos they uploaded themselves.

7. Reporting content or a person

Content that breaches article 4 can be reported directly from within the app. You can also block a user: they will then no longer be able to invite you or interact with you.

We review reports within 24 hours. Depending on severity, we may remove the content, warn its author, restrict their account or delete it. You can challenge a decision concerning you by writing to contact@evengo.ch.

You can also report content to us outside the app, at that same address.

8. Suspension and termination

We may suspend or delete an account that seriously or repeatedly breaches these terms, or whose use endangers the service or its users. Except in an emergency or where the law requires otherwise, we will tell you and give you the opportunity to explain.

For your part, you may stop using Evengo and delete your account at any time, without notice or justification.

9. Availability

We do our best to keep the service running, but we guarantee no level of availability. Evengo may be interrupted for maintenance, may change, and individual features may be modified or withdrawn. A prolonged outage would be announced as far as possible.

Do not use Evengo as the only backup of your photos. Keep your originals on your device or in your own backup solution.

10. Liability

Evengo is provided as is, free of charge. To the extent Swiss law permits, we accept no liability for indirect damage, loss of data, loss of profit, or the consequences of an event organised by means of the service.

This limitation does not apply in cases of intentional fault or gross negligence, nor where life or physical integrity is harmed. Mandatory provisions of Swiss law in favour of consumers are reserved.

We are not responsible for content published by users. We act as soon as we become aware of manifestly unlawful content, under the procedure in article 7.

11. Evengo's intellectual property

The Evengo name, its logo and its interface are protected. These terms grant you no rights over them, other than the right to use the app normally.

12. Personal data

How your data is handled is set out in the privacy policy, which forms an integral part of these terms.

13. Changes to these terms

We may amend these terms. Significant changes will be announced in the app at least 30 days before they take effect. If you do not want them, you can delete your account before that date; continuing to use Evengo afterwards counts as acceptance.

14. Partial invalidity

Should any clause of these terms prove invalid, the others remain applicable, and the invalid clause is replaced by the legal rule closest to its intent.

15. Governing law and jurisdiction

These terms are governed by Swiss law, excluding its conflict-of-laws rules. The ordinary place of jurisdiction is the publisher's seat, in Vevey. Mandatory fora provided by law are reserved: if you are acting as a consumer, you keep the right to bring proceedings before the court where you are domiciled.
